What does this Privacy Statement cover?
This Privacy Statement explains how we process and protect your Personal Data as a data controller, in particular when you use this website and contact us through https://www.jamtech.ch/, or otherwise interact with us as part of our potential or existing business relationship with you or with the company you are representing.
This Privacy Statement does not apply to the extent we act as a Data Processor on behalf of our client, in particular when we process Personal Data of our clients’ customers as part of the IT services provided by us. This processing of Personal Data is covered by the client’s privacy policy.
Unless otherwise defined in this Privacy Statement, the definitions used have the same meaning as in the Swiss Federal Data Protection Act and the EU General Data Protection Regulation.
What Personal Data do we collect and for what purposes?
We may collect Personal Data for certain reasons related to our business activities when you use our website or otherwise interact with us. This may include the following:
- Leads and Customer requests
When you contact us, we collect your Business Contact Information (for example: name, e-mail address, telephone number, address), information about your request and any other Personal Data you provide to us in connection with such requests.
This data is processed for the purpose of responding to your enquiries. The legal basis for processing your Personal Data is the performance of a contract or to take steps prior to entering into a contract.
- Log Files
You can visit our websites without providing any Personal Data. However, please note that each time a website is accessed, the web server automatically stores data in the server log file, such as IP address, the date/time a webpage is accessed, and information about the browser or operating system.
This data is processed for the purpose of ensuring the trouble-free operation of the website, based on our legitimate interest in providing and maintaining our website.
- Publications and Newsletters
We may process our customer’s name and email address to send relevant articles, including news related to the IT sector and about our company to keep them informed about industry trends and our latest services.
This communication is based on our legitimate interest in providing valuable insights and engaging with our customers. We ensure that these communications are relevant and not excessive.

How do we collect Personal data?
We collect your Personal Data through various channels and means including, but not limited to: (i) when you visit our official website; (ii) when you provide your business cards; (iii) during online or on-site meetings when conducting our business; (iv) when you contact us via email, phone, instant messaging services or through our social media account.
With whom do we share your Personal Data and why?
We may share your Personal Data with third parties for purposes of supporting the operation of our business, such as to: (i) provide and maintain our website (ii) provide data storage and communication services (iii) comply with legal obligations and defend our rights as authorised by law. These third parties include:
- Website hosting providers;
- Cloud storage providers;
- Accounting advisors and legal consultants;
- Public authorities or bodies as required or authorised by law.
Whenever these third parties are acting on our behalf, we make sure that they process your Personal Data only according to our instructions and are obliged to maintain confidentiality.
Where do we store your Personal Data?

Where necessary and unless the country to which data is being transferred has been determined by the European Commission or the Swiss Federal Data Protection and Information Commissioner as a country with adequate level of protection, we require such service providers to comply with data protection measures such as standard contractual clauses.
For how long do we keep your Personal Data?
We retain Personal Data for as long as it is necessary for the purposes for which it was collected or in compliance with legal and regulatory requirements or contractual provisions.
In case we enter into a contract with you, your business contact information and requests are kept for the contractual period and to the extent necessary to comply with legal and accounting obligations. In case of inactive leads not converted into a customer, your Business Contact Information is stored for 12 months.
Which security measures to protect your Personal Data do we have in place?
We take all appropriate technical and organizational security measures to protect your Personal Data against manipulation, loss or unauthorized access by third parties. Our security measures are continuously adapted to technological developments. These measures include role-based access controls, use of e-mail security protocols (e.g., DMARC), Two-Factor Authentication, as well as data encryption in transit and at rest.
What are your privacy choices and rights?

- You have the right to request a copy of your Personal Data
You can ask us to provide you a copy of your Personal Data, as well as to provide you with supplementary information about, for instance, the categories of Personal Data we process, the purposes, and the categories of third parties to whom your Personal Data is shared with.
- You have the right to data portability
You can ask us to transmit your personal data to another controller in a conventional electronic format, such as an Excel file, to the extent that it concerns Personal Data based on your consent or to perform our contractual obligations.
- You have the right to make us correct inaccurate Personal Data
You can ask us to correct our records if you believe they contain incorrect or incomplete information about you.
- You have the right to be "forgotten" by us
You can ask us to erase your Personal Data when it is no longer necessary for the purposes for which it was collected or when it has been unlawfully processed.
- You have the right to ask us to restrict the processing of your Personal Data
You can ask us to restrict (or “limit”) the processing of your Personal Data if you consider that they are inaccurate, that our processing is unlawful or that we no longer need to process them for the original purpose.

You can object or ask us to “stop” processing your Personal Data where the legal basis for our processing of your personal data is our legitimate interest.
We will comply with your request unless we have a compelling legal basis for the processing that overrides your interests or we need to continue processing the personal data for the exercise or defense of a legal claim.

If you have given your consent to the processing of your Personal Data, you have the right to withdraw it with future effect. Once we have received notification of your withdrawal of consent, we will no longer process your information for the purposes for which you initially consented, unless the processing is based on another legal basis.
At the moment, our Company does not carry out activities where your consent is required.
- You have the right to lodge a complaint regarding our use of your Personal Data
You have the right to appeal to a data protection supervisory authority if you believe that the processing of your Personal Data infringes data protection laws.
